Ebay buyer filed a claim "not as described"?It's been almost 30 days? Offered a refund?

I sold a ring that I the buyer claimed was "not as described" the buyer was rude and unwilling to come to any agreement with me (I posted it as a comfort band,it was my mistake) but the ring is in great shape,and it's real 14k white gold.thick.It's now been 29 days since the buyer made a claim and I responded immediately and Just heard from him today almost a month later stating "will send the item my father has been ill a week" I think he's blowing smoke,just how long does he have to send this thing back to me!? And they still get to withhold my money though he has my item!? (he got it for $100! Well worth more! LOL
